Terms & Conditions :

All business entered into by Sheila Rodgers with clients and associates (hereinafter called ‘the Client’), by internet, phone or traditional business routes are subject to the conditions set out below.

BOOKING & ENQUIRIES

It is considered that a booking is made once it is stated and agreed by Sheila Rodgers and/or The Client, by internet, phone, in person or any other method of communication that work will proceed at an agreed time (day or week). Anything before the point of this booking agreement is considered an enquiry.

CANCELLATION

Work as a booked designer per day/hour:
On having confirmed a booking, by email, phone, in person or otherwise this cancellation policy will apply:

  • cancellation within 5 working days; 50% of the payment fee of the number of working days cancelled will apply.

  • within 3 working days; 75% of the payment fee of the number of days cancelled will apply.

  • one working day prior to the booking; 100% of the payment fee of the number of days cancelled will apply.

  • cancellation outside of 5 working days does not incur a fee.

Work under contract:

On cancellation of a contract a fee of 50% will apply or, if the number of hours worked is more that 50% of the total payment, a fee will be charged for the full amount of hours worked. Only in exceptional circumstances will another fee be agreed by Sheila Rodgers for work that has been cancelled and will never proceed for whatever reason.

Urgent Requests or under high pressure:

A minimum notice of 24 hours should be given to commence work. If work is urgently needed within 24 hours a higher rate may be charged. This will be discussed with the client on enquiry.

HOURS OF WORK AND CONTACT

Normal working hours are between 10am and 6pm, Monday to Friday. It is possible to request work to be done outside of these hours but a higher rate may apply. This will be discussed with the client on enquiry.

All communication regarding work is done between 9am and no later than 8pm, Monday to Friday and 10am to 5pm, Saturday.  There is no obligation to answer calls or emails outside of these hours.

PAYMENT TERMS

Existing clients can avail of 30 days credit from the date of the invoice, or within 8 weeks of the date when the job commences.

For new clients, and for jobs commissioned over the Internet, on agreement of quotation, payment will be made in three-stage payment; one-third before work commenced, one-third during the project and finally payment on completion.

The minimum charge for any commissioned job is one hour.

Late Payments Fees; the payment grace period is 8 weeks from the date when the job commences. Fees will apply for payments delayed past 8 weeks starting on the first day of the 9th week. The Client will be notified as to the charges as they are billed.

QUOTATIONS

Quotations are valid for 30 days from date of issue. Quotes for third party fees and costs are subject to + or – 15% margin of error. Similarly, hourly rate changes will not affect projects already begun. Please bear in mind that while best attempts are made to try to estimate costs as accurately as possible, quotations cannot be binding.

CHANGES

Quotations cover the Client for a number of changes within the estimate schedule quoted for the particular job. Change requests made beyond the estimated time quoted will be made with fees accumulating at the hourly rate.  On rare occasions the design brief given by the Client may change after work commences, should this situation arise a revised design cost will be negotiated.

IMAGE PROCUREMENT

Purchase of images are made on behalf of the Client, the standard term & conditions apply to the use of these image i.e. licence length, restriction of use, publication run etc. a full set of these terms and conditions are available on request and the responsibility of adhering to them lies entirely with the Client’s.

DESIGN ARTWORK FILES

Artwork and template files will remain with the designer. Unless already agreed, there will be a fee to handover artwork source files to the client.

CLIENT PROPERTY

Client property left with Sheila Rodgers, including confidential material, will be carefully protected but is entirely at the Client’s risk.

COURIERS & DELIVERY

All courier and delivery charges will be passed on to the Client.

PRINCIPLE

The principle of the Design service offered is a consultancy whereby the Client seeks commissioned work based on professional experience, expertise and opinion. Sheila Rodgers will work with the client and agree the best course of action.

DISPUTES

All queries and disputes must be notified in writing within seven days of the date of the invoice or receipt of goods. The ownership of the work or goods supplied shall be retained by Sheila Rodgers until Sheila Rodgers has received payment in full by the Client and ownership has been previously negotiated and agreed.

BACK-UP SERVICE

Sheila Rodgers may provide a back-up service for projects for commencement to completed. This facility while beneficial to the Client is carried out for reference of the work by Sheila Rodgers only. Sheila Rodgers does not accept responsibility for any lost or damaged with respect to this service.

FORCE MAJEURE

Every effort will be made to carry out the contract, but its due performance is subject to variation or cancellation as a result of an inability to secure labour, materials or supplies, or as a result of any Act of God, War, Strike, Lockout or other Labour dispute, Fire, Flood, Draught, Legislation or any other cause beyond our control.

LEGAL LIABILITY

The Client is also responsible for checking all work before production commences and before print or going live on websites in regard to ethical and legal matters and matters of fact, financial transactions, technical contracts, spelling, accuracy, language, translation and other aspects of the final recommended work.

The Client is responsible for maintaining regular checks on live systems provided by Sheila Rodgers which include, but are not limited to, renewal of online services such as hosting packages and domain names services, social media, email, other online accounts, information stored online and financial services and transactions. Sheila Rodgers is not liable or responsible for losses incurred by deactivation or failure of these services in any way.

The Client shall be responsible for all costs and damages arising out of any action which may be taken or threatened against Sheila Rodgers in respect of any alleged breach of the law in connection with the work done by Sheila Rodgers for the Client including breaches of Copyright and Licensing.

The laws of the Republic of Ireland shall govern the contract between Sheila Rodgers and the Client, of which these standard terms & conditions form part. We reserve the right to change our terms and conditions from time to time, affecting all new contracts.

PLEASE NOTE: These terms and conditions take precedence over any other contract agreements, especially those drafted by the Client, unless specifically agreed to and notified in a special clause entitled “Waiving normal contract terms and conditions”. Any other contract terms will be honoured unless they contradict those specified in these Terms and Conditions.
